Allahabad High Court

RAJUversusSTATE OF UTTAR PRADESH AND 2 OTHERS

Decided

Holding

The Court held that it may direct the respondent to decide the pending case within a stipulated period under Section 219 of the Uttar Pradesh Land Revenue Act, 1901.

Summary

The petitioner, Raju, filed a writ petition seeking a direction to the Additional Commissioner (Judicial) of Prayagraj to decide the pending case No.148 of 2024 (Urmila Devi vs. Raju) under Section 219 of the Uttar Pradesh Land Revenue Act, 1901. The petitioner alleged that the case, arising from a revision filed under Section 219 against a 2015 order of the Tehsildar, had been pending since 15 January 2024. The State’s standing counsel expressed no objection to the petition being disposed with a direction to the respondent. The Court examined the delay and the statutory provision empowering it to direct administrative authorities to act. Consequently, the Court disposed of the writ petition, directing the respondent to decide the pending case within four months of the order’s certification.
