Allahabad High Court

INDRAWATI PANDEYversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court directed the Additional District Magistrate to decide the pending case within four months, thereby granting the writ of mandamus.

Summary

The petitioner, Indrawati Pandey, filed a writ petition seeking a mandamus directing the Additional District Magistrate (Land/Revenue) of Mirzapur to decide a pending case (No. 315 of 2026) under Section 30(1) of the Uttar Pradesh Land Revenue Code, 2006, which had been pending since 07.08.2025. The petitioner argued that the delay violated the statutory requirement for timely adjudication. The State, through its standing counsel, raised no objection to the direction. The Court examined whether the magistrate could be compelled by mandamus to decide the case within a specific timeframe. Finding no impediment, the Court ordered the magistrate to decide the pending case within four months of receiving a certified copy of the order. The petition was consequently disposed with the mandated direction.

Issues considered

  • Whether a writ of mandamus can be issued to compel the Additional District Magistrate to decide a pending case under Section 30(1) of the U.P. Land Revenue Code, 2006 within a stipulated period.
