Allahabad High Court

BELAL AHMADversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The court held that no direction for expeditious disposal could be issued while the lawyers remain on strike, and dismissed the petition.

Summary

Petitioner Belal Ahmad sought an order for expeditious disposal of a pending civil suit (Case No. 20018 of 2025) before the Allahabad High Court. The court observed that the lawyers involved in the suit were on strike, causing no progress in the proceedings. Relying on the Supreme Court's decision in High Court Bar Association Allahabad v. State of U.P. (2024) the court held that no direction for speedy disposal could be issued at this stage. Consequently, the writ petition was dismissed, with a direction that the petitioner may file a fresh petition if and when the strike ends and the case reaches a stage where a direction is appropriate. The order must be annexed to any such future petition.
