Allahabad High Court

SAVITRIversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The Court may issue a mandamus directing the Additional Commissioner to decide the pending revision within a reasonable period.

Summary

Petitioner Savitri filed a writ petition under Article 226 seeking a mandamus directing the Additional Commissioner (Administration), Azamgarh Division, to decide Revision No. 388/2025 (Ashwani alias Mauzi v. Tehsildar) filed under Section 219 of the Uttar Pradesh Land Revenue Act, 1901, which had been pending since 15 February 2025. The petitioner argued that the delay violated the principle of expeditious justice. The standing counsel for the respondents raised no objection to the petition being disposed of with a direction to the Additional Commissioner. The Court held that it could issue a mandamus directing the administrative authority to decide the pending revision within a reasonable time. Accordingly, the petition was disposed of with an order directing the respondent to decide the revision within four months of receipt of the certified copy of the order.
