Holding
The court held that there is no case for expeditious disposal of the appeal and dismissed the petition, while allowing the petitioner to seek a stay‑vacation order.
Summary
Ram Karan filed a petition on 6 April 2026 seeking expeditious disposal of an appeal in which he is the opposite party, arguing that a status‑quo order is causing him hardship. The petitioner’s counsel urged the court to decide the appeal promptly. The court observed that only one or two dates have been fixed for the appeal and, relying on the Supreme Court’s decision in High Court Bar Association Allahabad v. State of U.P. (2024) 3 ADJ 295, found no justification for accelerated hearing. Consequently, the petition was dismissed, but the court permitted the petitioner to file a stay‑vacation application if desired. The court directed that any such application be decided within two months of filing.
Issues considered
- Whether a petition for expeditious disposal of an appeal is maintainable when only a few hearing dates are fixed and a status‑quo order is in place
- Whether the Supreme Court precedent in High Court Bar Association Allahabad v. State of U.P. precludes such expedited relief
Subjects
- expeditious disposal
- status quo order
- stay vacation application
- writ petition
- Supreme Court precedent
- High Court Bar Association case

Court No. - 4
HON'BLE KSHITIJ SHAILENDRA, J.
1. The petitioner has hurriedly rushed to this Court for expeditious
disposal of appeal, which was filed only on 06.04.2026.
2. Learned counsel for the petitioner submits that since a status quo order
has been passed, the appeal should be decided and that the petitioner
being opposite party in the appeal is suffering.
3. Be that as it may, since only one or two dates have been fixed in the
appeal, no case for expeditious disposal of the appeal stands made out in
view of the Constitution Bench judgment of Hon'ble Supreme Court in
the case of High Court Bar Association Allahabad Vs. State of U.P.
and others: 2024 (3) ADJ 295, however, the petition stands disposed of
with liberty to the petitioner to press his stay vacation application by
taking appropriate proceedings and in case such an application is pressed,
appropriate orders in accordance with law shall be passed on the said
application within a period of two months.
