Holding
The Court directed the respondent to decide the petitioner's firearm licence application within two months, without adjudicating on the merits.
Summary
The petitioner, Dharmendra Singh, filed a writ petition seeking a direction to the second respondent to decide his pending application for a firearm licence filed on 20.01.2024 under Rule 25 of the Arms Rules, 2016, as the legal heir of the original licencee. He alleged that despite the lapse of a sufficient period, his application had not been considered. The State's standing counsel contended that the application, if unconsidered, should be decided by the competent authority in accordance with law. The Court, after hearing both sides, directed the respondent to decide the application within two months of the certified copy of the order, without expressing any view on the merits. Consequently, the petition was disposed with the said direction.
