Allahabad High Court
MAHENDRA PRATAP SINGHversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
The Court ordered the U.P. State Medical Faculty to consider and register the petitioner’s BPT degree as directed in the earlier judgment.
Summary
The petitioner, Mahendra Pratap Singh, filed a writ petition seeking a mandamus directing the U.P. State Medical Faculty, Lucknow to register his Bachelor of Physiotherapy degree. The respondents argued that the matter had already been decided by a coordinate bench in Shailesh Kumar Mishra v. State of UP, which ordered registration of the petitioners. The High Court examined the prior judgment and found no reason to deny the petitioner the same facility. Consequently, the Court allowed the writ petition, directing the Faculty to consider the registration within the stipulated time and warning that any concealment of facts could lead to a recall application. The order effectively grants the petitioner the registration he sought.
Issues considered
- Whether the petitioner is entitled to registration of his BPT degree with the U.P. State Medical Faculty.
- Whether a writ of mandamus is the appropriate remedy to compel registration.
