Allahabad High Court
MOHD IRFANversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The Court ordered the bank to de‑freeze the petitioner’s account except for the disputed amount, granting the relief sought.
Summary
Petitioner Mohd Irfan filed a writ petition seeking a mandamus directing the respondent bank to release his frozen bank account No. 50200026185212. The petitioner relied on the precedent set by the Lucknow Bench in Khalsa Medical Store v. Reserve Bank of India (Writ‑C No.12211 of 2025). The respondents did not dispute the factual matrix or the applicability of that precedent. The Court examined whether the bank was obligated to unfreeze the account except for the disputed amount. Relying on the earlier judgment, the Court ordered the bank to de‑freeze the account while retaining the right to re‑freeze it if any further suspicious transactions are detected. The petition was disposed with the specified direction.
Issues considered
- Whether the bank is mandated to release a frozen account upon a writ of mandamus.
- Whether the precedent of Khalsa Medical Store v. RBI is applicable to the present facts.
- Whether the court can limit the release to amounts not under dispute.
