The petition is dismissed as the concerned authorities have already initiated proceedings and are reconstructing the Khadanja, rendering a mandamus unnecessary.

Summary

Ram Saware Pathak, a resident of Nevada Bhavapur in Ayodhya district, claimed that a Khadanja (drainage) constructed under the MNREGA scheme in 2014‑15 on his land was destroyed by Devdhar Tiwari and his sons. He complained to the District Magistrate and Sub‑Divisional Officer in May 2024 but alleged no action was taken, and therefore filed a writ petition seeking a mandamus directing the opposite party No. 5 to comply with an order dated 30‑07‑2024 issued by opposite party No. 4 and to reconstruct the Khadanja. The Standing Counsel produced a BDO instruction dated 28‑08‑2024 showing that an inspection had confirmed the removal, that the Block Development Officer had directed the Village Development Officer to initiate proceedings against the perpetrators and to reconstruct the Khadanja, and that police action and an FIR were already underway. The court observed that the authorities were already acting on the matter and consequently dismissed the petition. The writ petition was therefore disposed of on 29‑08‑2024.

Issues considered

  • Whether the High Court can issue a writ of mandamus directing the respondent to reconstruct the Khadanja under the MNREGA scheme.
  • Whether the failure of the authorities to act on the petitioner's complaint amounts to a breach of statutory duty warranting judicial intervention.
  • Whether the petition is maintainable in view of the steps already taken by the revenue and development authorities.

Subjects

  • Writ petition
  • Mandamus
