Allahabad High Court

SMT. RENU DEVIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court directed the Additional Sub‑Divisional Magistrate to decide the pending computer case expeditiously, preferably within four months, without expressing any view on the merits.

Summary

Petitioner Smt. Renu Devi filed writ petition (Writ‑C No. 7884 of 2026) before the Allahabad High Court seeking a direction to the Additional Sub‑Divisional Magistrate, Tehsil Sadar, Gorakhpur, to decide the pending computer case (No. T202205310319896) against her within a fixed period. The petition also requested that notices not be issued to the private respondents. The court, after hearing counsel, held that notices to the private respondents were unnecessary. While declining to opine on the merits of the underlying criminal case, the court directed the magistrate to decide the matter expeditiously, preferably within four months of receipt of the certified copy of the order, subject to no legal impediment. Accordingly, the writ petition was disposed of finally with the said direction.
