Allahabad High Court

MOHAMMAD JILANI AND 3 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court directed the Commissioner to decide the revision case expeditiously, preferably within six months from the date of the order.

Summary

The petitioners filed a writ petition before the Allahabad High Court seeking a direction to the Commissioner, Prayagraj Mandal, to decide Revision No.824 of 2022 (Mohammad Jilani & others v. Rasheeda Khatoon & others) within a stipulated period. The petition alleged delay in disposal of the revision case. The Court heard counsel for both sides and noted that no opinion on the merits of the underlying revision would be expressed. It observed that the petitioners were entitled to a timely decision and that the Commissioner should act expeditiously. Consequently, the writ petition was disposed of with an order directing the Commissioner to decide the revision case within six months of receiving the certified copy of the order, unless a legal impediment exists.
