Holding
The appeal must be transferred to the Sessions Court because the complainant’s right of appeal under the proviso of Section 372 CrPC/Section 413 BNSS is limited to the next higher court.
Summary
The appellant, Sahjanand Hareshbhai Patel, filed an appeal under Section 378 of the CrPC and Section 419 of the Bharatiya Nagrik Suraksha Sanhita against the trial court’s acquittal on a charge under Section 138 of the Negotiable Instruments Act. The High Court, citing its recent decision in Shivsinh Ganpatsinh Solanki v. State of Gujarat (Criminal Misc. Applications 12753/2019 & 12908/2019, 23‑12‑2025) and the Supreme Court’s ruling in M/s Celestium Financial v. A. Gyanasekaran (2025 INSC 804), held that a complainant‑victim has a specific right to appeal to the next higher court – the Sessions Court – under the proviso of Section 372 CrPC/Section 413 BNSS. Consequently, the High Court did not consider the merits and ordered the transfer of the entire appeal record to the appropriate Sessions Court for disposal as an appeal under the said proviso.
Issues considered
- Whether an appeal against acquittal under Section 138 NI Act filed in the High Court is maintainable or must be transferred to the Sessions Court under the proviso of Section 372 CrPC/Section 413 BNSS.
- Whether the High Court has jurisdiction to entertain the appeal at this stage.
