Summary
The appellant, a complainant under Section 138 of the Negotiable Instruments Act, filed an appeal against the trial court's acquittal of the accused. The appeal was filed under Section 378 of the Code of Criminal Procedure, 1973 and Section 419 of the Bharatiya Nagrik Suraksha Sanhita, 2023. The High Court referred to its recent decision in Shivsinh Ganpatsinh Solanki v. State of Gujarat, which held that such appeals must be heard by the Sessions Court under the proviso of Section 372 of the Code and Section 413 of the BNSS. Consequently, the High Court disposed of the appeal with an order to transfer the entire record to the appropriate Sessions Court, without addressing the merits of the case. The order also directed the lower court to dispose of the matter expeditiously.
