Holding
The appeal must be transferred to the Sessions Court as the victim’s right of appeal under the proviso to Section 372 of the CrPC (or Section 413 of the BNSS) precludes the High Court’s jurisdiction.
Summary
Icon Financial Service, through Gautambhai Revabhai Chavda, appealed against the trial court’s acquittal on a charge under Section 138 of the Negotiable Instruments Act. The High Court examined whether it had jurisdiction to entertain the appeal under Section 378 of the CrPC and Section 419 of the Bharatiya Nagrik Suraksha Sanhita. Relying on the recent decision in Shivsinh Ganpatsinh Solanki v. State of Gujarat (Criminal Misc. Applications Nos. 12753/2019 & 12908/2019) and the Celestium Financial v. A. Gyanasekaran judgment, the Court held that the complainant, as victim, has a specific right to appeal under the proviso to Section 372 of the CrPC (or Section 413 of the BNSS) to the Sessions Court. Consequently, the High Court did not consider the merits and ordered the appeal to be transferred to the appropriate Sessions Court for disposal.
Issues considered
- Whether the High Court has jurisdiction to entertain an appeal against an acquittal under Section 138 of the NI Act.
- Whether the appeal should be filed under the proviso to Section 372 of the CrPC/Section 413 of the BNSS and thus be transferred to the Sessions Court.
