SHRIJI FINANCE AND LEASING THRO'GIRISHBHAI JASHBHAI PATELversusKESHABHAI DEVJIBHAI PATEL

Disposal
43-DISMISSED FOR DEFAULT @ FH

Holding

The appeal is dismissed for want of prosecution.

Summary

The appellant, Shriji Finance and Leasing, filed a criminal appeal (R/CR.A/2476/2008) against Keshabhai Devjibhai Patel and another. The appeal was listed twice, but the appellant's counsel failed to appear on both occasions, and had also been absent on an earlier hearing. The court observed that the appellant had evidently lost interest in pursuing the appeal. Given the prolonged inactivity and the fact that the matter originated in 2008, the court found no basis to continue the proceedings. Consequently, the appeal was dismissed for want of prosecution and the record was ordered to be sent back to the trial court.

Issues considered

  • Whether the appeal should be dismissed for want of prosecution due to the appellant's failure to appear before the court?

                                                  ORAL ORDER

The matter is called out twice. None remained

present even on both the calls. Even on earlier occasion,

learned advocate for the appellant was not present.

In view of above, it shows that the appellant has

lost interest to pursue the present appeal. The matter is of

the year 2008. Therefore, this Court has no option but to

dismiss the matter. Accordingly, the present appeal is

dismissed for want of prosecution. Record and proceedings be

sent back to the concerned trial Court, forthwith.
