High Court of Gujarat

KISHAN BALDEVBHAI RAVADversusSTATE OF GUJARAT

Disposal
58-RULE ISSUED & RULE ABSOLUTE/ALLOWED @FH

Holding

The Court allowed the application for regular bail, granting it subject to stringent conditions.

Summary

The petitioner, Kishan Baldevbhai Ravad, a 19‑year‑old, was arrested on 26‑Nov‑2025 in connection with an FIR (CR No. 11192006250255 of 2025) alleging offences under Sections 64(2)(m), 87 and 137(2) of the BNSS and Sections 4, 5(1) and 6 of the POCSO Act. The alleged facts state that the accused had a consensual relationship with a 17‑year‑old girl, living together as husband and wife for over a month. The petitioner filed an application for regular bail under Section 483 of the BNSS, claiming prolonged confinement and a lengthy trial. The State opposed bail, citing the seriousness of the charges and the conduct of the accused. After hearing both sides, the Court granted regular bail on a personal bond of Rs.10,000 with one surety, imposing conditions such as surrender of passport, residence reporting, and a one‑year prohibition from entering a specific police station, without expressing any opinion on the merits of the case.

Issues considered

  • Whether regular bail may be granted to the accused under Section 483 of the BNSS despite the nature of offences under the POCSO Act.
  • Whether the age and relationship between the accused and the victim preclude the exercise of judicial discretion in favour of bail.
