JEMISH DINESHBHAI SAVANIversusSTATE OF GUJARAT

Disposal
27-WITHDRAWN @ ADM.STAGE

Holding

The court may permit the withdrawal of an anticipatory bail application upon request of the applicant.

Summary

The applicant, JEMISH DINESHBHAI SAVANI, filed an anticipatory bail application and later sought the court's permission to withdraw it, invoking the principle laid down in Arnesh Kumar v. State of Bihar. The respondent, the State of Gujarat, opposed the withdrawal. The sole issue was whether the court could allow the applicant to withdraw the anticipatory bail application. The court, after hearing counsel, granted the request, noting that the law permits such withdrawal. Consequently, the anticipatory bail application was disposed of as withdrawn.
