Holding
The court exercised its discretion and granted temporary bail for seven days with a bond and reporting conditions.
Summary
Rahul alias Golu Kamleshbhai Gaud applied for temporary bail, citing financial assistance as the ground. The Additional Public Prosecutor waived service of notice on behalf of the State. The Court examined the application and, exercising its discretion, granted temporary bail for seven days upon the applicant furnishing a personal bond of Rs.10,000 and complying with conditions to surrender after the period and report to the nearest police station periodically. The order was made absolute and directed to be communicated to the jail authority. The application was therefore partly allowed, resulting in the applicant's temporary release.
Issues considered
- What is the appropriate discretion of the court in granting temporary bail on the ground of financial assistance?
- Does the waiver of service of notice by the Additional Public Prosecutor affect the grant of temporary bail?
