High Court of Gujarat

SANJAY @ JAGO JIVANBHAI BHUSADIYAversusSTATE OF GUJARAT

Disposal
56-DISPOSED AT ADMISSION STAGE

Holding

The court disposed of the bail application while reserving liberty to revive it if the trial is not concluded within eight months.

Summary

The applicant sought successive regular bail after the filing of a chargesheet. The trial report indicated that six witnesses remained to be examined, and the trial judge requested an additional 7-8 months to complete the trial. The High Court, noting the pending examination of witnesses and the anticipated delay, disposed of the bail application but granted the applicant liberty to revive the application if the trial is not concluded within eight months. No substantive merits on bail were decided; the order is procedural, linking bail relief to trial completion. The applicant may approach the court again if the trial exceeds the stipulated period.
