58-RULE ISSUED & RULE ABSOLUTE/ALLOWED @FH

Holding

The court granted temporary bail for 10 days on a personal bond of Rs.10,000, directing the applicant to surrender after the period.

Summary

The petitioner, Shobnaben @ Shobhaben Vinodbhai Rajghar, applied for temporary bail on humanitarian grounds, citing an aged, frequently ill mother and an upcoming daughter’s engagement. The Additional Public Prosecutor waived service of notice of rule on behalf of the State. The court examined the applicant’s circumstances and jail remarks indicating she had not been released and had satisfactory conduct. Exercising its discretion, the court granted temporary bail in part, ordering release on a personal bond of Rs.10,000 for a period of 10 days, with a direction to surrender after the bail period expires. The order also made the rule absolute and permitted direct service.
