Holding
Temporary bail was denied because the applicant's possession of a commercial quantity of ganja and his 27 prior criminal antecedents precluded any justification for release.
Summary
The applicant, Mahalingam Murugyyan Pillai, filed a temporary bail application seeking a 30‑day release to provide financial assistance to his family. The court noted that he was apprehended with a large commercial quantity of ganja and has 27 prior criminal antecedents for similar and other offences. Considering the seriousness of the narcotics charge and his extensive criminal record, the court found no sufficient ground to grant bail. Consequently, the application for temporary bail was rejected. The order was directed to be communicated to the jail authority.
Issues considered
- Whether the applicant is entitled to temporary bail despite being caught with a large quantity of ganja and having multiple prior convictions
