                                 ORDER


1.     Learned advocate Mr. Maulik M.Soni for the applicant
submitted that the charge sheet has not seen the light of the
day by way of the trial since the year 2020, further submitted
that the applicant is a business person and he has to
represent as a business analyst and advisor and currently has
to attend 139th Canton Fair scheduled to be held in China from
15th April, 2026 to 5th May, 2026.


2.     Advocate Mr. Soni submitted that since the applicant is
representative of the Company he has to further additionally
go to southern countries like Thailand, Malaysia, Indonesia,
Vietnam, Australia and west African countries. Therefore,
there would be a frequent visit to all the counties. Mr. Soni
stated that the applicant has Visa of almost all the countries
and the passport is expiring on 27.03.2026. Thus, stated that

  for the purpose of renewal of the passport as well as for the
  travel, the passport be released for a period of one year.


  3.          Learned APP submitted that the suspension of the
  condition for one year would be allowing the liberty to the
  applicant for not attending the trial, and stated that some
  stringent conditions be laid down.


  4.          Having considered the submissions raised and the
  affidavit produced with regard to the itinerary for the year
  2026,          the       condition             No.2          imposed             vide        order          dated
  24.06.2020 in Criminal Misc. Application No.208 of 2020 is
  suspended for a period of one year. The passport be handed
  over to the applicant, with further direction to the applicant
  that as and when he proposes to visit the foreign country for
  his business purpose, he shall produce the itinerary before the
  registry of the trial Court. The passport be deposited back
  after one year from today to the concerned Court.


  5.          In view of the above, the present application stands
  disposed of accordingly.
