High Court of Gujarat

SANJAYBHAI JADAVBHAI MAGHROLA THROUGH HETALBEN SANJAYBHAI MAGHROLAversusSTATE OF GUJARAT

Disposal
28-REJECTED @ ADM.STAGE

Holding

Parole leave was not granted as the petitioner failed to demonstrate a justifiable reason and had a history of absconding and poor conduct.

Summary

The petitioner, Sanjaybhai Jadavbhai Maghrola, filed a special criminal application seeking parole leave. The court noted that the petitioner had been released on 07-10-2025 for a 15‑day period but subsequently absconded for eight days. The jail records also reflected poor conduct and the application lacked any justifiable reason for granting parole. Considering the absconding, unsatisfactory conduct, and absence of a valid justification, the court found no case for parole. Consequently, the petition for parole leave was rejected.

Issues considered

  • Whether the petitioner is entitled to parole leave despite having absconded and exhibiting poor jail conduct.

                                                 ORAL ORDER

1. This petition is filed by the petitioner seeking parole

leave.

2. None present for the applicant. Heard learned APP and

perused the papers available on record.

3. The jail remarks indicate that the petitioner was

recently released on 07.10.2025 for 15 days and thereafter,

absconded for 8 days. Moreover, jail remarks show that jail

conduct of the applicant is not good and no justifiable reason

is given in the application for grant of parole leave.

Considering the same, no case is made out. The petition is

rejected, accordingly.

                                                                                  (SANJEEV J.THAKER,J)
