The petition for furlough leave was dismissed.
Summary
The petitioner, Babubhai Devabhai Bambhva, filed a special criminal application seeking furlough leave while in jail. The court examined the jail’s remarks and noted the petitioner’s poor conduct, including a 527‑day period of absconding after being released on temporary bail. The authority also expressed a risk that the petitioner might harass the complainant and his family, and no justifiable reason for furlough was provided. Consequently, the court rejected the application for furlough leave. The order was directed to be communicated to the jail authority.

ORAL ORDER
1. This petition, through jail, is filed by the petitioner
seeking furlough leave.
2. Considering the jail remarks, the conduct of the
applicant is not good. Moreover, earlier when the applicant
was released on temporary bail, he has been absconding for
527 days. The order passed by the authority also states that
there is a possibility of applicant harassing the complainant
and his family. No justifiable reasons have been given for
grant of furlough leave. Hence, the petition is rejected,
accordingly.
3. Registry to communicate this order to the concerned jail
authority.
