High Court of Gujarat

DILIPBHAI LAXMANBHAI CHAVDAversusSTATE OF GUJARAT

Disposal
58-RULE ISSUED & RULE ABSOLUTE/ALLOWED @FH

Holding

The court exercised its discretion and granted parole for four days with a personal bond, rather than the full 30‑day period sought.

Summary

The petitioner, Dilipbhai Laxmanbhai Chavda, applied for parole leave of 30 days to attend his sister’s post‑death ceremony. The Additional Public Prosecutor waived service on behalf of the State. The court examined the petitioner's jail record, noting he was released in February 2026, returned on time and had satisfactory conduct. Exercising its discretion, the court found the ground sufficient but granted parole for only four days, subject to a personal bond of Rs 10,000 and standard conditions. The order directs the petitioner to surrender to the jail authority at the end of the parole period.

Issues considered

  • Whether the petitioner is entitled to parole leave on the ground of a family funeral ceremony
  • Whether the court’s discretion can be exercised to limit the parole period despite the petitioner's request for 30 days
