Parole leave was denied as the petitioner had already been released recently, rendering the application untenable.
Summary
Amrutbhai Kachrabhai Prajapati filed a Special Criminal Application seeking parole leave for 30 days to provide financial assistance to his family. The application was made through the jail, with Ms. Shruti Pathak representing the State of Gujarat. The jail records indicated that the petitioner had been released from custody for a brief period from 5 December 2025 to 25 December 2025. The Court observed that, given this recent release, there was no sufficient ground to grant further parole. Consequently, the petition was rejected and the order was directed to be communicated to the jail authority.
Issues considered
- Whether parole leave can be granted to a prisoner who has recently been released for a short period.
