High Court of Gujarat

KARANBHAI RAMESHBHAI CHOUHANversusState of Gujarat

Disposal
28-REJECTED @ ADM.STAGE

Holding

Parole leave was denied as the petitioner failed to make out a sufficient case for such leave.

Summary

The petitioner, Karanbhai Rameshbhai Chouhan, filed a Special Criminal Application seeking a 30‑day parole leave to enable him to file an appeal against his conviction dated 22‑12‑2025. The jail records showed that he had been in custody for three months and eighteen days. The court examined whether the circumstances warranted parole for the purpose of filing an appeal. Finding that no sufficient cause was demonstrated, the court rejected the application. The order directed the registry to inform the jail authority of the decision.

Issues considered

  • Whether parole leave can be granted to a convicted prisoner solely for the purpose of filing an appeal when the prisoner has been in custody for over three months.
