The court held that the petitioner is entitled to parole leave for ten days, subject to bond and reporting conditions, because he satisfied the requisite criteria and had not yet used the ninth furlough leave.
Summary
The petitioner, Umedbhai Parshottambhai Talpada, applied for parole leave of 30 days to arrange finances and attend a family marriage. The State, represented by the Additional Public Prosecutor, waived service. The court noted that the petitioner had previously been released on furlough in October‑November 2025 and had returned on time, and that he had not yet availed the ninth furlough leave granted on 10 March 2026. Exercising its discretion, the court granted parole for ten days, subject to a personal bond of Rs.10,000, a condition to appear at the nearest police station, and surrender at the end of the period. Direct service of the order was permitted. The petition was allowed in part.
Issues considered
- Whether the petitioner is eligible for parole leave under the applicable provisions given his prior compliance and the unutilised ninth furlough leave
