The petition for parole leave was rejected as no case was made out in view of the petitioner’s prolonged absconding.
Summary
The petitioner, Ramjani Yakubhai Shekh, filed a Special Criminal Application seeking parole leave to challenge a matter before the Apex Court. The jail records indicated that the petitioner’s earlier appeal (No. 1078 of 2006) had been dismissed and that he had been absconding from 2010 to 2022, amounting to 4,347 days of unauthorized absence. The High Court examined whether the petitioner’s conduct warranted the grant of parole. Considering the extensive period of absconding and the dismissal of the earlier appeal, the Court found no sufficient ground to grant parole. Consequently, the petition was rejected and the order was directed to be communicated to the jail authority.
Issues considered
- Whether parole leave should be granted to a petitioner who has been absconding for a prolonged period and whose earlier appeal has been dismissed
