Holding
The court granted bail to the petitioner, finding the allegations against her to be general and noting her clean antecedent.
Summary
The petitioner, Sunita Devi, was named in an FIR alleging she participated in assaulting police officers and obstructing their duties during a rescue operation. She contended that the allegations were vague and that she had previously been exonerated in a 2019 case, establishing a clean antecedent. The prosecution opposed bail, citing multiple sections of the Bhartiya Nyaya Sanhita, 2023. The court observed that the charges against her were general and omnibus, and noted her clean record, concluding that she was not a flight risk. Accordingly, the court ordered her release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under CrPC Section 438(2) and BNSS Section 482(2).
Issues considered
- Whether the petitioner is entitled to bail despite being charged under multiple sections of the Bhartiya Nyaya Sanhita
- Whether the allegations against the petitioner are sufficiently specific to deny bail
