The Court allowed the anticipatory bail application, subject to conditions and verification of the petitioner’s antecedent.

Summary

The petitioner, Subodh Manjhi, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 35.7 litres of liquor. He argued that he has a clean antecedent, was not arrested at the spot, and that the liquor was recovered from a public place and from another individual’s possession, with no direct link to him. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs 500 with two sureties, subject to verification of his antecedent and compliance with Section 438(2) CrPC. The order also required the petitioner to deposit Rs 1,500 with the Lawyers’ Association within two weeks. The application was allowed, with the provisional bail to be confirmed if the petitioner’s clean antecedent is verified.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC for an alleged offence under Section 30(a) of the Excise Act where the accused was not arrested and claims no direct possession of the contraband.
