The court granted anticipatory bail to the appellant, directing release on bail upon arrest or surrender within eight weeks subject to Section 438(2) Cr.P.C.

Summary

Gaina Pandit (Rupesh Pandey) appealed against the Special Court’s order rejecting his anticipatory bail in a case involving offences under the Bihar N.S. and the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989. He argued that the notice was duly served, he has a clean antecedent, and that a similar appeal (Anant Sah & Manish Kumar, Criminal Appeal (SJ) No.5144 of 2025) had been granted anticipatory bail. The Special Public Prosecutor could not refute these submissions. The Patna High Court, considering the earlier judgment granting bail in the analogous case, directed that the appellant be released on bail if arrested or surrendered within eight weeks, upon furnishing a bail bond of Rs 10,000 with two sureties, subject to the conditions of Section 438(2) of the Cr.P.C. The order effectively granted anticipatory bail to the appellant.

Issues considered

  • Whether the appellant is entitled to anticipatory bail under the SC/ST Act offences.
  • Whether the prior order granting anticipatory bail in a similar case is persuasive authority.
