The appeal is allowed; the order rejecting bail is set aside and the appellant is granted bail with conditions.
Summary
The appellant Amit Kumar was charged under several provisions of the Bharatiya Nyaya Sanhita, 2023 and the SC/ST Act for allegedly stopping a motorcycle, assaulting the informant, attempting to kidnap his sister, using caste-based slurs and demanding money. The Special Judge had rejected his bail application. The appellant contended he was falsely implicated, pointing out that the victim’s statement under Section 183 of the BNSS did not incriminate him and that he did not publicly use the caste name. The State opposed bail, emphasizing the seriousness of the offences and the appellant’s prior criminal record. The Patna High Court, after considering the circumstances and the period of custody, set aside the lower court’s order and allowed the appeal, granting bail with a bond of Rs.15,000 and two sureties, subject to conditions of appearance and family surety. The order directs release on bail pending trial.
Issues considered
- Whether bail can be granted to an accused charged under the BNSS and SC/ST Act for alleged caste-based assault and attempted kidnapping.
- Whether the alleged use of caste name by the appellant satisfies the requirements of the SC/ST Act.
- Whether the victim’s statement under Section 183 BNSS exonerates the appellant from the charges.
