The appeal is allowed; the order rejecting anticipatory bail is set aside and bail is granted subject to Section 438(2) CrPC conditions.

Summary

The appellants, Jitan Sah and Laddu Sah, appealed against the Special Court's order dated 23‑11‑2023 that denied them anticipatory bail in a case involving offences under several IPC sections and the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. They contended that they have clean antecedents and were falsely implicated, arguing that the FIR does not specifically allege a caste‑based offence. The Special Public Prosecutor opposed the bail application. The Patna High Court examined whether the allegations justified denial of anticipatory bail and whether the FIR sufficiently disclosed a caste‑based atrocity. Finding the allegations vague and not caste‑specific, the Court set aside the lower court's order, allowed the appeal, and directed that the appellants be released on bail if arrested within eight weeks, subject to conditions under Section 438(2) of the CrPC.

Issues considered

  • Whether the appellants are entitled to anticipatory bail under Section 438 of the CrPC.
  • Whether the FIR discloses a specific caste‑based offence attracting liability under the SC/ST (Prevention of Atrocities) Act.
  • Whether the lower court erred in rejecting the anticipatory bail application.
