Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bail bonds and verification of his criminal antecedent.

Summary

The petitioner, Sitaram Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging recovery of 51,400 litres of liquor from a public place. He argued that he was not arrested at the spot, no liquor was found in his possession, and the recovery was based on secret information, suggesting a possible false implication. The State opposed the bail, citing the petitioner’s antecedent of four prior cases, three of which were also under the Excise Act. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.20,000 with two sureties, subject to the conditions of Section 438(2) CrPC. The order also stipulated verification of the petitioner’s criminal antecedent, with the provisional bail to be confirmed only if the antecedent does not exceed four cases.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC given his prior criminal antecedents and the nature of the alleged offence under the Excise Act.
