Anticipatory bail is granted to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
Summary
Petitioner Yogendra Yadav applied for anticipatory bail after an FIR alleged that he assaulted the sons of an informant with an iron rod, invoking several offences under the Bharatiya Nyaya Sanhita. The petitioner asserted his innocence, claimed the injuries were minor, and highlighted his clean antecedent. The State, represented by the Additional Public Prosecutor, opposed the bail on the ground of the seriousness of the accusations. The Court examined the nature of the alleged offences, the extent of injuries, and the petitioner’s prior record. Considering these factors, the Court granted anticipatory bail, directing that if arrested within eight weeks, the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order also directed compliance with the Judicial Magistrate‑I of Jamui for bail formalities.
Issues considered
- Whether anticipatory bail should be granted in a case involving multiple offences under the Bharatiya Nyaya Sanhita
- Whether the nature of alleged injuries and the petitioner’s clean antecedent justify bail
