The Court granted provisional anticipatory bail to the petitioner, subject to bail bonds, sureties, and verification of his antecedent.
Summary
The petitioner, Vishwanath Rai, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case alleging violation of Sections 30(a) and 37 of the Excise Act for possession of 5 litres of liquor. He argued that he has a clean antecedent, the liquor was recovered from a joint family house and not from his personal possession, and the case relied on a confessional statement of an accused in police custody, which he claimed lacks evidentiary value. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds and sureties, subject to verification of his antecedent and compliance with Section 438(2) CrPC conditions. The order also stipulated that if any antecedent is discovered, the bail would not be confirmed. The application was allowed.
Issues considered
- Whether anticipatory bail can be granted when the alleged offence involves possession of liquor under the Excise Act.
- Whether a confessional statement of an accused in police custody is admissible for granting bail.
- Whether joint family ownership of the premises negates deemed possession by the petitioner.
- Whether the petitioner’s clean antecedent is a requisite condition for anticipatory bail.
