Provisional anticipatory bail is granted subject to verification of the petitioner’s antecedent and compliance with the conditions imposed under Section 438(2) of the Cr.P.C.

Summary

Santosh Kumar was implicated in a case under Section 30(a) of the Excise Act for allegedly recovering 45 litres of liquor from a motorcycle, despite not being arrested on the spot and claiming he was not the owner of the vehicle. He has eight prior cases under the Excise Act. He applied for anticipatory bail, arguing lack of conscious possession and procedural lapses in the investigation. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.40,000 with two sureties and verification of his criminal antecedent. The order stipulates that if more than eight prior cases are found, the bail will not be confirmed; otherwise, it will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in view of his prior criminal antecedents and the nature of the alleged offence under the Excise Act.
