Patna High Court

Rohit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to stringent conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

Rohit Kumar, owner of a JCB, was implicated in an FIR alleging illegal soil cutting from government land under Sections 303(2), 317(2), 132, 3(5) of the Bharatiya Nyaya Sanhita and Section 194 of the Motor Vehicles Act. He contended that the JCB was used without his consent, that his driver and another individual had already been arrested, and that he had no prior criminal record. The State opposed his bail, arguing that stringent conditions were necessary to prevent future offences and possible tampering with evidence. The Court considered the fact that two co‑accused were already in custody and applied the principles of Section 482(2) of the BNSS. It granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of family surety, cooperation with trial, non‑interference with witnesses, and abstention from similar offences. The order emphasized that breach of any condition would lead to cancellation of bail.

Issues considered

  • Whether bail should be granted to the petitioner under the circumstances of the FIR and pending trial
  • Whether imposing specific conditions under Section 482(2) of the BNSS is appropriate to safeguard the trial
