Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Srikant Kumar, sought bail fearing arrest in a case (Athmalgola P.S. Case No.173 of 2025) involving alleged ransom demand, assault, and offences under the Bharatiya Nyaya Sanhita and the Arms Act. He contended that the allegations were vague, that co‑accused Nitish Kumar and Satish Kumar had already been granted anticipatory bail, and that he had no prior criminal record. The State opposed the bail application. The Court noted the precedent of anticipatory bail to similarly situated co‑accused and, applying Section 482(2) of the BNSS, ordered bail on condition of a bond, sureties, and compliance with several conduct conditions. The order directed that bail be effected if the petitioner is arrested or surrenders within six weeks, subject to the stipulated terms.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged.
  • Whether the grant of anticipatory bail to co‑accused mandates similar relief to the petitioner.
  • Whether Section 482(2) of the Bharatiya Nyaya Sanhita permits the Court to grant bail in this circumstance.
