Holding

The court held that anticipatory bail may be granted conditionally under Section 438(2) of the Criminal Procedure Code, subject to verification of the petitioner’s antecedent.

Summary

Chandan Kumar applied for anticipatory bail in a case under Sections 30(a) and 41(1) of the Excise Act for allegedly recovering 3,602.16 litres of liquor from a truck. He claimed he was not arrested at the spot, had no conscious possession of the liquor, and was not the owner of the seized vehicle, alleging that a watchman with whom he had a personal enmity implicated him. The State opposed the bail, pointing to the seriousness of the offence and the petitioner’s antecedent of four prior cases. The Court examined the submissions and, applying Section 438(2) of the Cr.P.C., directed that provisional anticipatory bail be granted on a bond of Rs.20,000 with two sureties, subject to verification of his criminal antecedents. The order further stipulated that if the verification reveals more than four prior cases, the bail would be withdrawn; otherwise, it would be confirmed. The application was allowed, and the petitioner was released on provisional anticipatory bail pending further verification.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged excise offences and his prior criminal antecedents.
