The petitioner is entitled to regular bail.
Summary
The petitioner, Pintu Sao, was arrested in connection with a case alleging that he and co‑accused forced an informant's aunt to execute a sale deed, assaulted her with a rod causing head injury, and stole money. The petitioner claimed he was falsely implicated, that the specific assault allegation pertained to co‑accused Raja Kumar, and highlighted his handicapped status, clean antecedent, and willingness to cooperate with the investigation. The State opposed bail, emphasizing the grievous injuries suffered by the victim. The Court examined the nature of the allegations, the petitioner's health and background, and the period of custody already served. Considering these factors, the Court ordered that the petitioner be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties.
Issues considered
