The Court granted pre‑arrest bail to the petitioner subject to a bond and verification of criminal antecedent.
Summary
The petitioner, Aslam Alam, applied for pre‑arrest bail in a case registered under Sections 126(2), 115(2), 109(1), 74, 351(2), 352 and 3(5) of the Bihar Negotiable Securities Act (BNS), alleging that he acted in self‑defence during a fight with the informant and his wife. The State opposed the bail, contending the seriousness of the offences. The Court examined the FIR, the claim of self‑defence, and the petitioner’s clean antecedent, finding a prima facie case for bail. It directed that the petitioner be released on pre‑arrest bail upon furnishing a Rs.10,000 bond with two sureties, subject to Section 438(2) of the Criminal Procedure Code and Section 482(2) of the BNS. The Court also ordered verification of any other criminal cases against the petitioner, stating that the bail order would lapse if such antecedents are found. The bail application was consequently disposed of with the grant of bail.
Issues considered
- Whether the petitioner is entitled to pre‑arrest bail under Section 438 Cr.P.C. and Section 482(2) BNS in view of the allegations.
- Whether the claim of self‑defence establishes a prima facie case for bail.
- Whether the condition of verifying the petitioner’s criminal antecedent affects the bail order.
