Patna High Court

Yuvraj Yadav @ Yuraj Yadav @ MunnaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond, sureties, and the conditions of Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Yuvraj Yadav, was accused of having an illicit relationship with the complainant's wife, eloping with her, two children, and jewelry worth Rs.3,15,000. The complaint was lodged four months after the alleged incident, without a satisfactory explanation for the delay. The petitioner sought bail fearing arrest under Sections 76, 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, while the State opposed the bail. The court considered the delay in filing the complaint and the nature of the allegations, and decided to grant bail on the condition of a Rs.10,000 bond, two sureties of equal amount, and compliance with Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. The bail is to be surrendered within eight weeks if the petitioner is arrested or surrenders.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the alleged offences.
  • Whether the four‑month delay in filing the complaint is a ground to deny bail.
  • Whether bail can be conditioned under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
