Patna High Court

Domi Dharikar @ Domi DhanikarversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

The petitioner, Domi Dharikar, sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Excise Act for alleged recovery of 36 litres of liquor from a location adjacent to his house. He argued he had a clean antecedent and that the alleged recovery was not from his possession, relying on a confessional statement of another accused in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If any prior case is found, the bail would not be confirmed; otherwise, the provisional order would be confirmed. The order was made under Section 482(2) of the Bihar Negotiable Securities Act.

Issues considered

  • Whether anticipatory bail can be granted when the allegation is based solely on a confessional statement of an accused in custody.
  • Whether the petitioner’s clean antecedent warrants provisional anticipatory bail under Section 30(a) of the Bihar Excise Act.
