The Court held that anticipatory bail may be granted under Section 438 CrPC notwithstanding the petitioners’ antecedents, provided they furnish the prescribed bail bonds and the trial court verifies their criminal records.
Summary
The petitioners, three individuals from East Champaran, applied for anticipatory bail under Section 438 of the CrPC in connection with a case alleging offences under Sections 30(a), 32 and 41(1) of the Excise Act involving the alleged recovery of 170 litres of liquor. They contended that they were not arrested at the spot, no liquor was found in their possession, and the accusation stemmed from an unnamed local informant, raising doubts about the prosecution’s case. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioners be released on provisional anticipatory bail upon furnishing bail bonds of Rs 15,000 each with two sureties, subject to verification of their criminal antecedents by the trial court. The order stipulated that if the petitioners’ antecedents exceeded the disclosed numbers, the bail would not be confirmed; otherwise, it would be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC in the present case.
- Whether the absence of arrest and lack of possession of the alleged liquor justify granting bail.
- Whether the petitioners’ prior criminal antecedents affect the grant of anticipatory bail.
- Whether the conditions imposed by the Court are appropriate and lawful.
