The Court granted regular bail to the petitioners, subject to a bond and sureties.

Summary

The petitioners, Bheem Singh and Yogendra Singh, were arrested in connection with a case alleging that they, along with others, assaulted and kidnapped the cousin of the informant over a disputed payment for a JCB machine. The informant claimed the accused threatened the victim’s life unless the money was returned. The petitioners contended that they were falsely implicated, had clean antecedents, and that the alleged victim had no actual injury. The State opposed the bail, emphasizing the seriousness of the offences under Sections 137(2), 140(1) and 3(5) of the B.N.S., 2023. The Court, after considering the clean record, the period of custody already served, and the lack of injury, ordered that bail be granted on condition of a bond of Rs.10,000 with two sureties. Consequently, the petition for regular bail was disposed in favour of the petitioners.

Issues considered

  • Whether regular bail should be granted to the accused under Sections 137(2), 140(1) and 3(5) of the B.N.S., 2023 given the nature of the allegations
  • Whether the petitioners’ clean antecedent and the period of custody already served justify bail
