The Court allowed the anticipatory bail application, granting provisional bail subject to bond and verification of antecedents.
Summary
Chandani Devi, the wife of Raj Kumar Mandal, applied for anticipatory bail in a case registered under Section 30(a) of the Excise Act for the alleged recovery of 27 litres of liquor from her auto. She argued that she was not arrested at the spot, had no conscious possession of the liquor, and was unaware that the driver, Saurabh Kumar, would misuse her vehicle. The State opposed the bail. The High Court, considering her clean antecedent and the fact that ownership of the vehicle alone does not constitute participation in the offence, directed that she be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of her antecedents under Section 438(2) of the Cr.P.C. The court clarified that if any criminal antecedent is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Cr.P.C.
- Whether ownership of the vehicle used in the alleged offence implicates the petitioner under Section 30(a) of the Excise Act
- Whether the petitioner's clean antecedent warrants the grant of bail
