Patna High Court

Pintu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Pintu Kumar, applied for anticipatory bail after being implicated in a kidnapping case under Sections 137(2), 140(3) and 96 of the B.N.S. The informant alleged that Kumar kidnapped her minor daughter on 23 October 2025, but the victim later gave a statement under Section 183 CrPC stating she had gone to her aunt’s house, and the aunt’s statement contradicted the victim’s claim. The petitioner’s counsel argued that he has a clean record and that the statements were false, possibly made under pressure from the victim’s mother. The State opposed the bail. The Court, noting the lack of corroborative evidence, the victim’s non‑cooperation, and the petitioner’s clean antecedents, directed that he be released on anticipatory bail upon furnishing bail bonds and sureties, subject to conditions under Section 482(2) of the B.N.S.S. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in the kidnapping case.
  • Whether the statements of the victim and her aunt render the prosecution’s case weak enough to justify bail.
