Patna High Court

Vinod Yadav @ Vinod KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to a bail bond and sureties, under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Vinod Yadav, sought anticipatory bail fearing arrest in a case involving offences under Sections 126(2), 115, 109, 303(2), 352, 351(2), 103(1) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The prosecution alleged that on 15 March 2025 the petitioner was present at the scene where co‑accused assaulted the husband of an informant, leading to the victim's death. The petitioner contended that the FIR only implicated co‑accused Pintu Yadav and Ajay Yadav in the assault and that there was no overt act attributable to him, noting that a similarly situated co‑accused had already been granted bail. The State opposed the anticipatory bail. The Court, after considering the facts, granted anticipatory bail to the petitioner, subject to a bail bond of Rs.10,000 and two sureties, and conditioned it on compliance with Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether the allegations in the FIR constitute an overt act sufficient to deny bail.
  • Whether Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, can be invoked to grant bail.
